What to expect in court when arrested for a DUI in Sacramento

The Sacramento County courthouse is located in downtown Sacramento between 7th and 8th Streets and G and H Streets.  There is metered parking around the courthouse but it is recommended that you opt to park in the public lot on the 7th Street side of the courthouse or in the lot connected to the ally on the 8th Street side.

Upon entering the courthouse you will be subject to a search similar to that in an airport. You cannot bring any weapons or contraband into the courthouse.

The DUI department in Sacramento is Department 2 located on the first floor of the courthouse.

First appearance are routinely at 8:15 am in Department 2.  Do not be late you may miss the announcements or embarrassed by the bailiff.

Before entering Department look for your name on the calendar posted outside Dept. 2 to confirm that your name is on the calendar and that you are in the right place.

Once the Bailiff unlocks the door be seated inside and remember to remove your hat.  Along that line, make sure to dress appropriately.  Dress conservatively as though you were attending church.

If you have hired a private attorney your attorney can appear without you being present pursuant to Penal Code Section 977.  The judge will not hold it against you if you are not present at this first appearance.  Make sure to confirm this with your attorney before the first court appearance.

It is at this first court appearance that the court will advise people that if they cannot afford an attorney one will be appointed for them.  The court will then inquire as to your monthly income to determine if you qualify for appointed counsel.
