A marijuana dui case is much different than an alcohol dui.  In Sacramento County and in many Northern California Counties like Yolo, Placer and El Dorado district attorneys acknowledge the difficulty in proving such cases by offering reduced plea offers like a Wet Reckless conviction under Vehicle Code 23103.5.

Unlike alcohol which can be measured in a subject blood or breath to a .08 percent standard no such test is available for marijuana.  Little has been studied about driving impairment caused by marijuana.
