President of US Ski and Snowboard Asso. arrested for DUI

The Associated Press reported, the President of the U.S. Ski and Snowboard Association, Bill Marolt, was arrested in Park City, Utah last Wednesday, St. Patrick’s Day, on suspicion of DUI. According to the Summit County Sheriff’s Office jail log, Marolt was charged with DUI.

Bay area Mom and Boyfriend use 13 year old son as designated driver to avoid DUI

Mill Valley Mom, Heather Choulos plead guilty to charges of child endangerment according to Associated Press reports after being accused of using her 13 year old son as a designated driver.  Apparently the 13 year old was chauffeuring his mother and her boyfriend around in a Land Rover after dinner to avoid getting “another dui”.

Mill Valley is an upscale Bay area neighborhood across the Golden Gate Bridge from San Francisco.

According to police Choulos and her boyfriend have prior dui convictions according the the police.

On March 10th I contacted Choulos’ lawyer Scott Guite who said he did not intend on making any statement to the press.

Multiple DUI convictions or Prior DUI’s

It is always important to pull the clients prior plea forms to examine if the pleas were taken properly.  The client must have entered into the plea knowingly and intelligently.  The language of the forms should be closely examined for any defects.  Audio recordings and transcripts from the rendering court should be ordered and examined as well.

A clients prior may be stricken for all purposes if the challenge is successful.

Sen. Roy Ashburn, just another reason reason not to trust politicians.

Republic Sen. Roy Ashburn, after a history of anti-gay voting including his, “No” vote against gay marriage has now come out of the closet admitting he is guy.  It was only after reports sprung up relating to his recent arrest for DUI that the Senator was gay did he finally admit it.

This 55 year old father of four claims that his anti-gay votes were based on the desires of his constituents.   Really?  This, powerful, elected public leader is only a wind sock of public opinion?  If his contingency wanted to take away the civil rights from other minorities apparently he could justify that too?

While certainly he may be subject to punishment for his DUI by the courts but, there are no sanctions for lying to the public which is arguably the greater social harm.  Despicable and hypocritical are just a few adjectives that could be used to describe this behavior.

As Shakespeare wrote, “May outward appearances be least themselves.”  Or how about the old, “Do as I say, not as I do” adage?

Once again we are left with another example of a conservative moral majority leader willing to say anything to obtain his own personal goals.  Don’t our “leaders”  at least owe us their honesty?

Perhaps Ashburn can team up with Senator Larry Craig of Idaho to form a hypocritical task force.

Anti-Gay Republican busted for DUI after leaving gay nightclub

The Huffington post and other news organizations have reported that Early Wednesday March 3rd, State Senator Roy Ashburn a California Anti-Gay republican was arrested for DUI after leaving a gay nightclub.  Ashburn was known to be a fierce opponent of gay rights.  When he was pulled over by police he was driving his state issued vehicle and there was an unknown male passenger seated next to him.

Ashburn, issued the following apology for the incident:

“I am deeply sorry for my actions and offer no excuse for my poor judgment. I accept complete responsibility for my conduct and am prepared to accept the consequences for what I did. I am also truly sorry for the impact this incident will have on those who support and trust me – my family, my constituents, my friends, and my colleagues in the Senate.”

Arizona police officer arrested for DUI – provides questionable information to police

Twenty Seven year old Arizona police officer Seth Samuel Castillo was found at around 10 am on January 3rd by police a Gilbert police officer.  Castillo was reportedly unconscious behind the wheel of his Jeep at the intersection of Princeton and Douglas 4 houses away from his home.

The officer attempted finally woke Castillo and ordered him out of his vehicle at which time Castillo became resistant and reached toward his waist causing the officer to shot Castillo with his taser.

Castillo reported that he drank two 24 ounce beers and the  prescription drug Ritalin.  Reports are that his test result was .173, above the legal limit of .08.

While it is unknown what type of beer he consumed most beers range in alcohol content between 4 percent and 6 percent alcohol and are 12 ounces.

Assuming the test results are a correct measurement of his blood alcohol level, if Castillo was drinking a 4.5 percent alcohol beer and he consumed a total of 48 ounce or the equivalent of 4 beers that could provide enough alcohol to get to get his blood alcohol level of .173 if he weighed less than 85 pounds.

If he was drinking a beer that was twice as strong as 4.5 % alcohol (now 9% alcohol), that would contain enough alcohol to get Castillo to a .173 if he weighed 170 pounds.  However these calculations do not account for “Burn Off”.

“Burn off” is a term used to describe the bodies metabolization of alcohol or the process of eliminating of alcohol.  The average person burns off approximately .02 per hour which is about the equivalent to one standard size and strength drink.

Oilers Goalie Khabibulin slapped with Arizona DUI charges..

Khabibulin is charge with violating Arizona’s “Extreme DUI” statute.  The “Extreme” title is to denote an enhanced penalty which also stipulates that the offender’s driver’s licence be revoked. In addition, an ignition interlock device is required.

It is reported that Khabibulin has only minor traffic violations on his record but no alcohol related offense.

Not yet a full moon but, Timberwolves Al Jefferson popped for DUI

February 28th, 2010

Early reports are that The Timberwolves Al Jefferson was arrested for DUI early Sunday morning Feb. 28th.  Coach Kurt Rambis says he doubts this arrest will result in a suspension this reason since his first court appearance date is not until April 23rd.  However, being arrested and facing charges is bound to affect his game.

Sunday March 14th the Tiberwolves are scheduled to play the Sacramento Kings in Sacramento.  In an unrelated incident Kings Forward Nocioni recently plead to a DUI in Sacramento and is currently on probation.
